  • Application Processing Timeline: It mandates the ATF to complete background check applications within three days. If not finalized within this period, the application is automatically approved.

Senators Advocate for the Bill

Senator Jim Risch (R-ID), principal sponsor of the legislation, emphasized the bill’s importance in safeguarding the Second Amendment rights of law-abiding citizens. He stated:

“Law-abiding gun owners wrongfully denied their Second Amendment rights should be able to appeal their case through an efficient, transparent process. My ATF Transparency Act is simple. It codifies the current appeals process, holds the ATF to a higher standard, and gives Idaho’s lawful gun owners a faster, fairer process for firearm applications.”

Senator Roger Marshall (R-KS) voiced his strong support for the initiative, declaring:

“As a lifelong gun owner and supporter of the Second Amendment, I came to the Senate with the mission of protecting this sacred Constitutional right of all Kansans. The ATF Transparency Act furthers this mission by requiring the ATF to develop an appeals process to protect Americans’ background checks from being wrongfully denied.”

Similarly, Senator Steve Daines (R-MT) highlighted the relevance of the Second Amendment in individual lives, asserting the need for an efficient appeals process:

“The Second Amendment is an integral part of our Montana way of life, and law-abiding citizens should not have to worry about their constitutional rights being denied because of a processing error.”

Support from Pro-Gun Organizations

The ATF Transparency Act has garnered endorsement from several pro-gun organizations, including Gun Owners of America (GOA). The organization’s Director of Federal Affairs praised the legislation:

“Gun Owners of America is proud to endorse Sen. Risch’s legislation to eliminate ATF’s bureaucratic loopholes in the already unconstitutional National Firearms Act. A Right Delayed is a Right Denied.”

GOA asserts that this legislation represents a significant step toward rectifying issues concerning the ATF’s management of firearm applications and background checks, aiming to reduce bureaucratic delays that affect law-abiding gun owners.

Political Context

This legislative effort is part of a broader Republican strategy to counter the administration’s perceived overreach regarding gun safety regulations. In January 2025, a companion bill was presented by Representative Russ Fulcher (R-ID), further demonstrating the commitment to curtailing restrictions affecting gun ownership.
